LX Hausys has clinched a final victory in the Supreme Court regarding a patent invalidation lawsuit over its insulation technology.
According to LX Hausys on the 1st, the Supreme Court recently dismissed an appeal filed by Myungil Foam Co., upholding the lower court's ruling in a patent invalidation lawsuit targeted at LX Hausys.
The legal battle dates back to March 2022, when LX Hausys filed a patent infringement lawsuit against Myungil Foam concerning its phenolic foam insulation manufacturing technology, which enhances both eco-friendliness and thermal performance. In response, Myungil Foam filed a petition to invalidate the registration of the patent in June of the same year.
With this Supreme Court ruling, the validity of LX Hausys's patent, titled "Phenolic Foam, Manufacturing Method Thereof, and Insulation Material Comprising the Same," has been finalized.
In February, the Patent Court ruled in favor of LX Hausys during the appellate trial, judging that the patent met all disclosure requirements and presented novel technical challenges and solutions compared to preexisting insulation technologies.
Specifically, the court recognized the validity of the patent on the grounds that LX Hausys successfully achieved simultaneous improvements in thermal conductivity and eco-friendliness through the development of new polymerization techniques and parameters.
Myungil Foam appealed the decision to the Supreme Court, but the highest court ultimately dismissed the case.
With this decision, the four-year legal dispute has officially concluded with a victory for LX Hausys.
"We will continue to dedicate our efforts to developing insulation products that meet the demands of the market and our customers, while actively protecting our intellectual property rights," an LX Hausys official stated.
